Caveat Emptor and the Sale of Land: The Erosion of a Doctrine
AbstractThe author examines the doctrine of caveat emptor and the exceptions to this doctrine that the courts have recognized In particular, the requirements for disclosure on behalf of the vendor are examined, especially in relation to latent defects in land. The author concludes that, with the increasing exceptions to caveat emptor, the doctrine may be headed toward a rather limited and distinct application.
